Art Series returns information
All of the art pieces in The Art Series are produced to a very high standard in the UK. They are also produced to order, meaning there is no stock holding of art work, they are simply produced when an order is received. Returns can only be accepted if the Art Piece has been damaged upon delivery. A photograph must be taken and the delivery slip market with damaged upon receipt. Please call Jonathan to clarify and issues.
Breech of Copyright
Copyright laws are taken very seriously at Jonathan Davies Photographic. You may only use any images as described at the time of sale once full payment is made. The full force of the copyright law will be used to pursue any illegal copyright breeches.
Video Production Contract
1. The Purpose of this document is to establish a contract between Jonathan Davies Photographic hereinafter referred to as PRODUCER, and (Insert Client's Legal Name), hereinafter referred to as CLIENT for the production of ????. (define the project -is it an audio/visual project, animation project, Internet project, film, video project?), hereinafter referred to as the PROJECT.
2. PRODUCER offers to produce the PROJECT for CLIENT in exchange for a value consideration as specified in Paragraph 7 below.
3. DESCRIPTION OF THE PROJECT: The PROJECT is to be a (length of time in hours, minutes), (Briefly describe the project -such as 'Interactive Sales Training CD' or 'Corporate Capabilities Video Presentation), entitled (Insert Name or Working Title of this project).
The purpose of the PROJECT is (State the Purpose Here).
No other use of the project is anticipated, nor have terms of consideration been agreed upon to for any but the use specified herein. (for example, finished video to be used in commercials, sales training programs and on the Internet, specify the use.)
4. The PRODUCER shall work with the CLIENT to assist with a written script, or a production storey-board in a format standard to the production industry, (assistance may be needed from a copywriter at an additional cost) prior to the start of production. CLIENT shall have the right to approve said script or stipulate changes thereto in order to make said script suitable for approval for the CLIENT.
5. CLIENT shall approve the written production budget submitted in advance by the PRODUCER.
PRODUCER warrants that the production shall cost no more than the grand total listed on said budget without prior written consent of the CLIENT. CLIENT reserves the right to increase, “not decrease” said budget at any time after budget approval.
6. PRODUCER insures to provide a finished version of the PROJECT to the CLIENT within a reasonable time frame at the CLIENT'S place of business which is

7. The grand total of the production budget for PROJECT approved by the CLIENT is £ (Write the Amount) :
This total is payable as follows:
* 40%, or £ (Calculate 40% of the project total and write it here) deposit to confirm project
· Balance of final 60% plus any agreed-upon additions, or £ (Calculate the final balance and write it here) upon delivery to CLIENT of the finished project.
8.Where the brief includes shooting facilities, products, businesses, manufacturing process. CLIENT will assist with a liaison officer to be present at shoots where expert knowledge of procedures, process or content to be filmed exists. For example shooting manufacturing processes. Failure to provide expert liaison will result in no liability by the PRODUCER for delays and costs incurred for re-shoots or re-edits because no expert was on hand. The CLIENT is responsible for ensuring that all performers, sets, locations, products and procedures to be filmed are ready for the recording. For example if we are attending to film a hotel ensure that all rooms to filmed are presented as you wish them to be portrayed. The PRODUCER can accept no liability for increased shooting time / days due to last minute alterations to sets / locations / talent / props etc.
9.If filming venues are being organised by the CLIENT, it is the CLIENTS responsibility to ensure that the PRODUCER has clear access to all relevant locations required throughout the day. The CLIENT is responsible for any costs in obtaining permission to film in the agreed location(s). Delays in filming may incur additional charges. It is the customer’s responsibility to ensure that permission has been given to film in all venues. The PRODUCER will not be responsible for coverage lost, due to access restrictions. In the event that the venue charges a fee for filming, the customer will be liable for this fee. Arrangements should be made for all venues to be accessible by The PRODUCER at least one hour before the time of each event; this is to be arranged by the Customer(s).
10. There are no other agreements or codicils relative to this PROJECT between either of the parties hereto either verbally or in writing, and this document constitutes the entirety of the contract.
I have read, understand and agree with every provision of this contract and by my signature, hereby certify that I accept and agree to abide by them and that I am competent and legally qualified to enter in to such a contract.

Commercial Photography Contract
1. The Purpose of this document is to establish a contract between Jonathan Davies Photographic hereinafter referred to as the PHOTOGRAPHER, and (………………………….), hereinafter referred to as CLIENT for the production of ????. 2. PHOTOGRAPHER offers to produce the IMAGES for CLIENT in exchange for a value consideration as specified in Paragraph 7 below.

Wedding photography and Video Terms and Conditions
The photographer is retained as the exclusive official photographer for this wedding.
A non-refundable booking fee of 20% is charged when this contract is signed, this fee is deducted from the total price.
The balance will be due 6 weeks before the wedding.
The client understands that the photographic coverage will be as the photographer's professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort will be made to comply with the client's wishes.
The photographer shall be granted completed artistic licence including in relation to the poses photographed and the locations used. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all of the images requested.
All image sizes are nominal. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching.
The 1988 Copyright Act assigns the copyright to the photographer. It is an offence to copy or allow to be copied any photograph covered by this contract.
Although the photographer will do their best to produce more proofs/preview images than set out as discussed with the client, there is no guarantee that any number of proofs/preview images will be produced.
Display. The Client hereby allows the photographer to display any images included in this contract in their studio, portfolio, literature, website and other advertising.
The contract may be cancelled at any time by the client, giving written notice to the photographer, in doing so, shall forfeit any monies paid. Changing the date of the wedding will be considered as cancellation. If possible, the photographer will make every effort to be accommodate a new date, but if this is not possible due to another booking or previous engagement, then the booking fee would be forfeited.
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of this contract. Neither party shall be liable for indirect or consequential loss.
Any complaints should be raised by the client to the photographer in writing within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
I have read this booking form and agree by the terms of agreement set out in it. I understand that the terms of this agreement cannot be changed unless agreed by both parties in writing.
